Terms of Service

By accessing or using RaceFrame Market ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform. These terms apply to all users, including buyers, sellers (photographers), and visitors.

• You must sign in using a valid Google account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must be at least 18 years old to create an account.
• All accounts are created as buyer accounts by default. To sell on the Platform, you must explicitly apply through the "Sell on RFM" page and accept the Photographer Terms.
• We reserve the right to suspend or terminate accounts that violate these terms.

• When you purchase a photo, you are purchasing a digital license to use that image according to the license type selected (Personal or Commercial).
• Personal License: Grants you the right to use the image for personal, non-commercial purposes including personal prints, wallpapers, and social media (with photographer credit).
• Commercial License: Grants you the right to use the image for commercial purposes including marketing, advertising, merchandise, and publications.
• Neither license grants exclusive rights. The photographer retains full copyright ownership.
• You may not resell, redistribute, or sublicense the original files.

• All payments are processed securely through Stripe.
• A Platform Service Fee of $2.00 + 5% of the subtotal is added to each order.
• Prices are set by individual photographers and displayed in USD.

All digital download purchases are final and non-refundable. Due to the nature of digital media, we are unable to process refunds once a digital file has been delivered. By completing a purchase, you acknowledge and agree to this policy.

Once purchased, your files are available for download immediately and indefinitely through your "My Downloads" section. RaceFrame Market maintains the original files on our servers to ensure you can always re-download your purchases.

• To sell on RaceFrame Market, you must apply through the "Sell on RFM" page.
• You must provide a display name, set up your storefront, and accept these terms.
• Seller accounts are subject to approval. We reserve the right to reject or revoke seller status at any time.

• You retain full copyright of all content you upload.
• By uploading content, you confirm it is your original work and does not infringe on any third-party rights.
• You grant RaceFrame Market a non-exclusive license to display, watermark, and distribute your content for the purpose of operating the marketplace (storefronts, search results, previews).
• Data Retention: You grant RaceFrame Market a perpetual, non-exclusive license to store and serve purchased media files to buyers who have completed a valid purchase. Buyers retain access to re-download their purchases indefinitely. This ensures that customers can always access the digital content they have paid for.

• You set your own prices for Personal and Commercial licenses.
• RaceFrame Market charges a commission on each sale. Commission rates are determined by your subscription tier.
• Payouts are processed via Stripe Connect to your linked bank account.

Sellers are strictly prohibited from uploading content that is:

• Illegal, illicit, or prohibited by applicable law.
• Infringing on third-party intellectual property, copyrights, or trademarks.
• Obscene, defamatory, or harmful.
• Misrepresented as original work when it is not.
• AI-generated content presented as original photography.

Accounts found in violation will be permanently revoked without refund of any subscription fees.

All uploaded content is automatically watermarked with your photographer name for preview purposes. Buyers only receive the original unwatermarked file after completing a valid purchase.

The RaceFrame Market name, logo, and platform design are the property of RaceFrame Market. You may not use our branding without written permission.

RaceFrame Market is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or class action.

We may update these Terms periodically. Material changes will be communicated via email or a prominent notice on the Platform. Continued use of the Platform after changes constitutes acceptance.
